From Robert Reich:
Billie Eilish can’t run for president. She is under 35.Arnold Schwarzenegger can’t run for president. He was born in Austria.Donald Trump can’t run for president. He engaged in and supported an insurrection. It’s in the Constitution, folks.
Eta: there was already a post on the Reich quote. https://lemmy.world/post/9894249
Good. Fuck that traitor
We’re going to see if the country is run by laws, or this country is run by power. Too many have fantasized about ruling by power. Too long the opposition just blindly believed the system would check itself in an honor system. This case, from the home state of a confederate general, will reveal which path US chooses.
Every nation is run by both. That’s why the U.S. government was set up to have checks and balances. Clearly it’s not perfect, but no system is. At the end of the day, it’s a nation’s people that ultimately decide how their government behaves, even if that’s by apathy.
It’s not always a fair or balanced system though, some examples include the electoral college and voter disenfranchisement.
the home state of a confederate general
To be fair, also the state of Washington, Madison and 6 other presidents, more than any other state 🤷
Ah the real test: will a conservative state obey the law or the party.
Since we are ruled by the supreme court i’m not sure it will even matter.
Virginia is pretty much purple now. Perhaps still more of a reddish purple, but definitely not the deep red it used to be.
Apparently half of America is ok having an insurrectionist run for the highest office in the land.
Reminder:
He’s also a rapist.
He should be held accountable for his actions. If this was anyone else, there wouldn’t even be much of a conversation. Nobody forced his goofy behind to do an insurrection.
oh, i really hope that the Colorado decision sets off a domino effect of state after state removing Trump from the ballot. It wouldn’t even take many to succeed to ensure he’d lose in 2024… but, of course, if SCOTUS takes up the case, he could be off the ballot everywhere forever.
–> i really hope that the Colorado decision sets off a domino effect
Won’t be the first time! Amirite!!!

If you don’t like the 14th amendment, push for a new amendment to repeal it. If you really believe trump didn’t engage in insurrection, push for congress to exonerated him with a 2/3 vote of the house as provided for in the 14th amendment.
Trump, and anybody else, cannot ignore constitutional restrictions on office just b cause he’s popular.

I don’t appreciate you lying about that guy loving free elections.
It’s how the constitution works though. Are you saying the 14th amendment doesn’t apply to the president?
A Trump defender defying the constitution? Why, I never!
I think due process requires he be convicted first. They really need to get to work on that side of the problem.
The same would happen if your 18, not a naturally born citizen, or just didn’t meet the various state requirements for the primary.
If he is allowed to run for election, what prevents next candidate from hiring mafia to terrorize polling places?
There is a reason constitution has insurrection clause in it and what clown and his people did fits perfectly to the provisions under it. Not using 14th amendment is an open invitation for dictatorship.
Not using 14th amendment is an open invitation for dictatorship.
That argument only works if what you want to achieve is not a dictatorship.
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
So unless Congress votes for him to be on the ballot, he shouldn’t be on the ballot
It’s not what we think, it’s what he did.
Traitors, traditionally, receive no quarter. He should be walked to edge of a cliff and shot, if we are going by the “historical traditions of the US” as this SCOTUS has apparently mandated.
In the us the penalty for spying is death, I’d say just being disqualified is already lucky
It’s funny to me that you put it this way. Just because in the UK it is historically a punishment for traitors to be quartered.
Why do you hate the US Constitution so much?
This is how elections work for everyday criminals, and if people are being imprisoned for the actions of Trump, then why is Trump exempt from those rules?
Criminals cannot vote except in select states. And it isn’t like the people haven’t fought for those rights. Republicans have put stops to them.
This is more of a problem of Republican policy, eating at Republican actions.
There’s nothing stopping a convicted criminal from running, so long as they meet the usual requirements. Unless the crime is insurrection, where the 14th amendment kicks in. And Trump participated in Jan 6th so he’s out.
This is not the correct interpretation. There’s only insurrection that can get your banned - and that’s exactly what he did.
There’s only insurrection that can get your banned
Could you please elaborate on this? I have no idea what you are trying to say here.
Okay so they typed “your” instead of “you” but the fact remains that there’s one action which can cause you to be banned from becoming President (or a congressperson) and that action is insurrection. It was perfectly clear.
Other disqualifications (age, birthplace) aren’t under one’s control. Insurrection is a CHOICE.
Still need to follow due process. If he is guilty (and he probably is), you’ve got to convict him.
Yes it is… The Constitution says so. I’m sorry you don’t like it, but those are the binding rules.
If Trump stayed home on Jan 6 he’d still be on the ballot. Actions have consequences.

Notice that it was an insurrection long before anyone knew Trump would be trying to run for office again.
He realized he was going to lose the election, tried to steal it, failed, and then tried to keep office even though he had lost the election. It was an absolute embarrassment to the country and the man is a disgrace. The fact that anyone wants to vote for him is a testament to how well the media is at getting people to think what they want.
Care to expand on your statement?
alleges that Trump was an “insurrectionist” and cites that he isn’t legally eligible to hold office under state and federal law
This individual is asking the court to make a determination in whether Trump is eligible based on his involvement in January 6. That’s his right as a citizen, regardless of what you think of it.
