    Honestly, I’ve read this piece by Josh Marshal three times now and I’m not sure what he’s trying to claim. Is he saying that the fascist overreach by the federal government, of sending troops into states to terrorize citizens, isn’t too worrisome because the feds are articulating a law-based justification for doing it? That is to say, if they are still winking at the idea of doing ‘laws’, then the violence they are escalating won’t go too far. Am I interpreting that wrong?

    If that’s what Josh as actually saying, this is ridiculous liberal cope from an ideology that only values process and not principle. Look everyone, trump signed the forms in the right places, so you don’t have to worry about his goons cracking your kids’ skulls. Oh, elections happen on the state level, and the federal government is still referencing states as an entity in their bogus law fare filings, so we’re still okay.

    It’s precisely this kind of pedantic, legalistic, and frankly cowardly worldview that has kept the Democrats from mounting any kind of substantive opposition to the Republicans fascist project for 40 years. Some things actually aren’t that complex.
