The only potential argument is that only congress can declare war, but that’s been pretty much fucked since the end of WWII. It’s illegal for them to tell you to target civilians. It’s legal for them to tell you to invade some foreign nation, for any reason.

This is not clearly illegal. Disobeying these orders would get you a court martial, and they will say it was legal.
