This is gonna be like Capone: All these crimes and the thing that gets Trump behind bars is violating a gag order.

Because you know he can’t abide by it.

If there’s any such thing as Incitement Tourette’s, he’s got it.

Question since I’m genuinely lost when it comes to this - does forcing a gag order by these actions benefit Trump in any way? Does it ensure no one is able to speak about the case, or is it just limited to him?

IANAL - in both senses - but I don’t see how a gag order on other people would pass constitutional muster, especially with this Supreme Court.

Because that’s not technically illegal until the gag order, which went into effect after the post was made.

He wasn’t threatening. He was insulting. The word “attack” is misleading in this context.

The threat wasn’t explicit, but it was certainly implicit. That’s why he posted her personal social media info. He is fully aware he has an army of followers that will take that and run with it. I don’t think that he should be able to get away with that so easily.

Which is why he now has a gag order. The act of posting someone’s ig isn’t illegal, but now it is with the gag order.

If I had thousands of followers and I posted your social media info while insulting you, wouldn’t you consider that a threat? I don’t think a gag order, which was very narrow, is much of a punishment.

Legally that is not a threat. Now it is a violation of the gag order, which is illegal. A lawyer could try and argue it is a threat, but that could take much longer, set precedent for future cases, and isn’t as guaranteed as a gag order.

He was also inciting his followers.

Whether or not it rises to the level of “inciting imminent lawless action” is a different topic, but it’s not like he was merely insulting someone to their face - he was pointing tens of millions of his psycho followers at her.
