It may be assault, but only because assault is an extremely generic crime. It could also be considered self defense. At this point, many would consider ICE agents simply being nearby as an imminent threat of harm.
And IIRC from previous reports about this, the prosecution was pushing charges as a felony under a bullshit anti-terrorism clause, and I believe this was the third Grand Jury that chose not to indict.
There is no “may”. It is absolutely an assault. Assault doesn’t even require physical contact. Battery is arguable and might be a stretch, but it is definitely assault. And no, or was not self defense by any stretch.
As I said though, that’s normal times stuff. I don’t currently recognize Trump’s ICE as a legitimate law enforcement agency, or human beings really.
Yeah, calling it terrorism is bullshit, and actually could itself be considered terrorism in my opinion.
It may technically be assault but I’d challenge to you prove even the possibility of harm.
